Probate and information sharing

Hi everyone

Hope someone can quote an example or chapter and verse from Data Protection Act to enable me to instigate a  possible benefit fraud and get a LTE property back into use. 

To explain, I have a 6 year LTE probate property in North Dorset which the solicitor informs me the sole inheritor refuses to sign the Grant of Letters of Administration of the Estate in 2005.  Numerous tel calls, mailing and recorded delivery sent by solicitor to the beneficiary and signed for, but no response.  It has been established she can read, write and do signature - fully compus mentus.  5 years now I have been consulting solicitor and lady due to inherit to offer enabling support.  She continually refuses to confirm when she will sign for the property.

I have consulted Test Valley Borough Council, the LA she lives in to establish they will take action if it comes to light she is in receipt of benefits but has recourse to other income from house sale/rent.  They will take recovery action.

The issue I have is with my authority and hiding  behind Data Protection.  I have been forbidden to speak, email, write to TVBC quoting personal data to enable them to instigate and investigation.  I have sought advise from our Legal Dept - a long wait for feedback.  Nothing yet.

Has anyone a similar story where Data Protection Act worked to effect an outcome? 

A big sigh of frustration here....
